Terms of Service

By creating an account, uploading content or otherwise using the Service, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, do not use the Service.

Spot Digger is a platform for user-generated content. All locations, photos, videos, descriptions, routes, parking notes, accessibility info, safety notes, hiking times, weather notes and any other information are submitted by users.

Spot Digger does not review, verify, validate or endorse any user-submitted content. We make no representations or warranties about the accuracy, completeness, legality, safety or reliability of any content on the Service.

You visit and use locations found on the Service entirely at your own risk. You are solely responsible for:

• checking access rights and respecting private property,
• complying with local laws, regulations and permits,
• assessing weather, terrain, tides, road and trail conditions,
• understanding and following drone, photography and filming regulations,
• bringing appropriate gear, skills and experience for the location,
• your own and your group's safety.

To the maximum extent permitted by law, Spot Digger, its operators, contributors and affiliates are not liable for any injury, accident, death, property damage, fines, trespassing claims, lost or damaged equipment, travel costs, missed opportunities or any other direct, indirect, incidental or consequential loss arising from your use of the Service or from any content found on the Service.

Estimated travel times, route difficulty ratings, hiking durations, accessibility info, safety notes and AI-generated descriptions may be inaccurate, outdated or misleading.

You may only upload photos, videos, text, coordinates and other content that you own or that you have the necessary rights and permissions to use and share.

You retain ownership of the content you upload. By uploading content to the Service, you grant Spot Digger a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, display, reproduce, modify (for example resizing or cropping), promote and distribute your content within the Service and in marketing materials related to the Service (for example social media posts, newsletters and advertising).

You can remove your content at any time by deleting it from your account, which will end the license for future use (existing copies in caches or archived marketing materials may take time to disappear).

You may not upload content that is illegal, infringing, dangerous, deceptive, harassing or that encourages trespassing or other unlawful behavior. See our Community Guidelines for more detail.

Spot Digger may remove any content and suspend or terminate any account at its sole discretion, with or without notice, for any reason, including violations of these Terms.

You must be at least 18 years old to use the Service, or you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect means you accept the updated Terms.
